§1 Provider and contractual partner

(hereinafter referred to as ‘seller’ or ‘we’).
§2 Scope of application
These General Terms and Conditions (hereinafter ‘GTC’) apply to all contracts for the delivery of goods between coffee affair.s GmbH and visitors to www.coffee-affairs.com or www.coffee-affairs.de (hereinafter ‘Customer’ or you). The inclusion of the customer's own terms and conditions is hereby rejected, unless otherwise agreed.
The GTC apply in the version valid at the time of the order.
Customers within the meaning of these GTC are both consumers and entrepreneurs. Consumers are natural persons who enter into the contract for purposes that are predominantly outside their trade, business or profession. Entrepreneurs are natural or legal persons or partnerships with legal capacity who, when concluding the contract, are acting in the exercise of their commercial or independent professional activity.
Sales via the online shop operated at www.coffee-affairs.com or www.coffee-affairs.de are currently only made to customers within the European Economic Area.
§3 Conclusion of contract
- You can add an item from our range to your shopping basket by clicking the ‘Add to basket’ button on the relevant product page. You can view the contents of the shopping basket via the ‘Shopping basket’ button with the shopping basket symbol at the top right of the browser window. There you can change the desired number of items or delete the item from the shopping basket. Click on the ‘Checkout’ button to initiate the order process. You can then select the shipping method and payment method and check your order again and correct it if necessary. By clicking on the ‘Order with obligation to pay’ button, you submit a binding request to us to purchase the items in your shopping basket. The general terms and conditions are thereby included in your application. By submitting your request, you agree to an exclusively electronic invoice transmission.
- Upon receipt of your order, you will immediately receive an automatic confirmation of receipt from us by e-mail to the e-mail address you have provided that your order has been received. This is not yet an acceptance of your order, but is only to inform you that your order has been received and is being processed. The contract with us is only concluded upon receipt of our dispatch or collection confirmation (hereinafter ‘order confirmation’), which will be sent to you in a separate email. Our order confirmation will be sent by the end of the fifth working day following the day of your order. We will send you the text of the contract (consisting of your order, our GTC and our order confirmation) on a durable medium by email in the order confirmation or in a separate email, but at the latest upon delivery of the items. The text of the contract is stored at www.coffee-aaffairs.com in compliance with data protection regulations.
§4 Availability of goods
- If a specific product ordered by you is permanently unavailable at the time of ordering, we will inform you of this immediately by e-mail and refrain from sending an order confirmation. A contract will not be concluded. The possibility of accepting further requests contained in the order remains unaffected.
- In the event of cancellation of the contract in accordance with (1), we shall refund the service paid for without delay.
§5 Prices and shipping costs
- All prices quoted are final prices in euros and include statutory VAT. In the case of reduced prices, we will indicate the previous purchase price to which the reduction relates.
- The prices stated at the time of the order shall apply.
- In addition to the prices quoted, you will have to pay shipping costs. The shipping costs will be clearly communicated to you during the ordering process.
- From an order value of 200 euros, shipping costs within Germany will be waived. Additional shipping costs may apply for international deliveries.
- You can pay by Paypal, credit card or Shopify Payments.
- When ordering several products, in the event of cancellation of part of the ordered products (partial cancellation), a partial refund of delivery costs will only be made if the delivery of the products not cancelled would be cheaper without partial cancellation. This means that the delivery costs for the cancelled part of the order will only be refunded to the extent that they would not have been incurred anyway.
- If you return part of the products in your order (partial return), the delivery costs will not be refunded. You can find the more detailed provisions on our right of return below under §10
§6 Terms of payment
- Payment can be made by credit card, PayPal or Shopify Payments. If you have saved a payment method in your customer account, you can change the saved payment method at any time. You can also order and pay without a customer account.
- Payment of the purchase price is due immediately upon conclusion of the contract.
- When paying by credit card, the purchase price is already reserved when the order is placed. However, your credit card will not be charged until the ordered items have been dispatched. If you pay by PayPal, your bank/PayPal account will be debited when you place your order.
- If you select a payment method offered by PayPal, payment will be processed via the payment service provider PayPal (Europe) S.Á.R.L et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter ‘PayPal’), subject to the PayPal Terms of Use. If you pay via PayPal, we already declare acceptance of your offer at the time you click the ‘Complete order process’ button.
- If you select a payment method offered via ‘Shopify Payments’, payment will be processed via the payment service provider Stripe Payments Europe LTD, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter ‘Stripe’).
- If the payment method credit card via Stripe is selected, the invoice amount is due immediately upon conclusion of the contract. Payment is processed via the payment service provider Stripe. Stripe reserves the right to refuse a credit check and this payment method in the event of a negative credit check.
§7 Delivery conditions and dispatch
- Orders will be shipped to your address or, if desired, to a participating DHL packing station.
- Unless otherwise stated, the delivery time is 2-5 working days within Germany.
- Shipping is carried out by our contractual partner DHL.
- As a rule and where possible, your order will be delivered in one consignment. However, partial deliveries are possible, subject to prior notification, if it is not possible to complete the order.
- As an alternative to delivery, you can also choose to collect your order from Franz Morish Kaffeerösterei, Goldschmidtr. 39, 04103 Leipzig. If you choose to collect your order, you will be informed by e-mail when it is ready for collection.
- Delays in delivery due to force majeure or unforeseeable events authorise us to postpone delivery for the duration of the delay.
§8 Retention of title
- The delivered goods remain our property until the purchase price has been paid in full.
- Upon return of the fully paid goods by you or their receipt at the return address in accordance with §10, ownership is transferred back to us.
- §9 Right of cancellation

Right of cancellation
- You have the right to cancel the contract within 14 days without giving any reason.
- The cancellation period is 14 days from the day on which you or a third party named by you took possession of the goods.
- To exercise the right of cancellation, you must inform us (coffee affair.s GmbH, Goldschmidtstr. 39, 04104 Leipzig; e-mail: bestellung@coffee-affairs.com) of your decision to cancel this contract by a clear statement via e-mail.
- In the event of cancellation, we are obliged to reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within 14 days from the day on which we receive notification of the cancellation of the contract.
- You shall bear the direct costs of returning the goods, unless you would like us to send you a returns label.
CONSEQUENCES OF CANCELLATION
If you cancel this contract, we will refund all payments we have received within 14 days of receipt of the goods. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this repayment.
End of the cancellation policy
§10 Warranty for material defects, guarantee and right of return
- The statutory warranty rights apply to all goods, including clothing. This means that in the event of a defect in the delivered goods, we are obliged to rectify this within two years of receipt of the goods. A defect is deemed to exist if the delivered goods do not have the agreed quality at the time of delivery or are not suitable for normal use.
- Defects in clothing: The clothing is carefully checked before it is dispatched. However, if you discover a defect in the goods that was already present when you received them (e.g. defective seams, faulty workmanship or material defects), you can make a complaint about the goods. Defects in the goods must be reported by e-mail within 14 days of receipt of the goods. The goods should be inspected immediately upon receipt.
Exclusion of warranty: The warranty does not cover damage caused by improper use, incorrect care, excessive use or normal wear and tear (e.g. colour changes after repeated washing or a button coming off). There is also no warranty for clothing that has been damaged by improper care or cleaning.
In the case of products made of soft fabrics, fabric-like materials and yarns, minor deviations in length, width, weight, colour and fibre composition due to production technology do not entitle you to assert warranty rights. In the case of products that are manufactured or finished by hand, the product or finish may vary within a batch. Such minor deviations due to manual labour are not a defect.
- Fabrics and fabric-like materials are not absolutely dimensionally stable. Products made of soft fabrics, fabric-like materials and yarns can shrink by up to 8% after washing or ironing. Such deviations are not a defect.
- If the delivered goods are defective, you can choose to have the defect rectified (repair) or exchange the goods (replacement delivery).
- If the repair or replacement delivery fails, you can withdraw from the contract or reduce the purchase price.
§11 Liability
- We are only liable for damage caused by wilful or grossly negligent behaviour on our part.
- We shall only be liable for slight negligence in the event of a breach of essential contractual obligations (cardinal obligations), but limited to typical, foreseeable damage.
- We accept no liability for damage caused by improper use or improper storage of the goods
§13 Data protection
We process the personal data required for business transactions exclusively in accordance with the applicable data protection laws (GDPR).

§14 Final provisions
- The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
- If the customer is a merchant, our registered office is the exclusive place of jurisdiction for all disputes arising from the contractual relationship.
- Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes as close as possible to the economic purpose of the invalid provision.
- The European Commission provides a platform for online dispute resolution in consumer matters, which can be found at this link to the European Commission's platform. However, we are not obliged or willing to participate in such a dispute resolution procedure before a consumer arbitration board.
